Terms of Service

This website is operated by Marlow Label, a trading name operated by Seta Services.

Throughout this website, the terms “Marlow Label”, “we”, “us” and “our” refer to Marlow Label and its operating entity, Seta Services.

By accessing our website, creating an account, placing an order or purchasing products from us, you agree to these Terms & Conditions (“Terms”).

Please read these Terms carefully before using our website.

Nothing in these Terms excludes, restricts or modifies any consumer right or remedy that cannot lawfully be excluded under applicable law, including the Australian Consumer Law and the New Zealand Consumer Guarantees Act 1993 where applicable.

1. Online Store Terms

By using this website or placing an order, you confirm that:

  • You are legally capable of entering into a binding agreement, or
  • You are using the website with the permission of a parent or legal guardian where required

You must not use our website, products or services:

  • For unlawful or fraudulent purposes
  • To violate any applicable law or regulation
  • To interfere with the operation or security of the website
  • To transmit malicious software, viruses or harmful code
  • To impersonate another person
  • To provide intentionally false or misleading information

We may restrict or terminate access to our website where there is a legitimate reason to do so, including fraud, misuse, security concerns or a serious breach of these Terms.

2. About Marlow Label

Shop Name: Marlow Label
Operating Company: Seta Services
KVK / Chamber of Commerce Number: 92397379

Marlow Label is an online footwear retailer serving customers primarily in:

  • Australia
  • New Zealand

Our products are sold online and may be fulfilled through international logistics and fulfilment partners.

3. Product Information

We aim to present product information as accurately and clearly as reasonably possible.

Product pages may contain information including:

  • Product descriptions
  • Photographs
  • Available colours
  • Sizes
  • Materials
  • Measurements
  • Prices
  • Promotional information
  • Estimated availability

While we make reasonable efforts to ensure this information is accurate, minor differences may occur.

For example, product colours may appear slightly different depending on:

  • Screen settings
  • Device type
  • Lighting
  • Photography
  • Manufacturing variations

Such minor differences do not affect any rights you may have where a product is materially different from its description or otherwise fails to meet applicable consumer guarantees.

4. Prices

Product prices are displayed on our website in the currency indicated on the store or during checkout.

Prices may change from time to time.

Changes to pricing will not ordinarily affect an order that has already been accepted, except where:

  • A genuine and obvious pricing or technical error has occurred, and
  • Applicable law allows us to correct or cancel the affected order

If we are unable to accept an order because of a genuine pricing error, we will contact you and refund any amount already paid if the order is cancelled.

Promotional pricing may be available for a limited period and may be subject to separate promotional conditions.

5. Promotions & Discounts

Marlow Label may offer promotions including:

  • Storewide sales
  • Percentage discounts
  • Stack & Save offers
  • Multi-buy discounts
  • Bundle offers
  • Discount codes
  • Limited-time promotions

Promotional terms may specify:

  • Eligible products
  • Minimum quantities
  • Minimum order values
  • Promotion dates
  • Maximum discounts
  • Whether offers can be combined

Unless expressly stated otherwise, promotional offers cannot necessarily be combined with other discounts.

Where an order qualifies for a quantity-based discount, returning part of that order for change-of-mind reasons may result in the remaining items being recalculated according to the promotional tier they continue to qualify for.

Further details are contained in our Returns, Refunds & Cancellations Policy.

Promotional terms do not remove or restrict statutory consumer rights.

6. Placing an Order

When you place an order, you are making a request to purchase the selected products at the price shown during checkout.

After placing an order, you will normally receive an automated order confirmation email.

This confirms that we have received your order.

We may review orders before fulfilment for reasons including:

  • Payment verification
  • Suspected fraud
  • Incorrect information
  • Product availability
  • Technical errors
  • Duplicate orders
  • Unusual purchasing activity

An order is accepted when we confirm acceptance or begin fulfilment of the order.

If we cannot accept your order, we will notify you where reasonably possible and refund any payment taken for products we are unable to supply.

7. Order Refusal or Cancellation

We may refuse or cancel an order where there is a legitimate reason, including:

  • Suspected fraud
  • Unauthorised payment
  • Incorrect or incomplete customer information
  • Product unavailability
  • Genuine pricing errors
  • Technical errors
  • Legal or regulatory restrictions
  • Abuse of promotions
  • Orders placed for unlawful purposes

If we cancel an order after payment has been taken and no products are supplied, the applicable amount will be refunded to the original payment method.

We will not cancel orders arbitrarily or in a manner that removes rights you have under applicable consumer law.

Customer-requested cancellations are governed by our Returns, Refunds & Cancellations Policy.

8. Payment

Payment must be completed using one of the payment methods displayed during checkout.

Depending on availability, these may include:

  • Visa
  • Mastercard
  • American Express
  • PayPal
  • Other payment options supported by our checkout provider

Available payment methods may vary by location.

Payments are processed through authorised third-party payment providers.

Marlow Label does not directly store complete payment card information on its own website servers.

You agree to provide accurate and authorised payment information when placing an order.

9. Billing & Customer Information

You agree to provide current, accurate and complete information when placing an order.

This may include:

  • Full name
  • Billing address
  • Shipping address
  • Email address
  • Telephone number
  • Payment information

You are responsible for checking your information before completing an order.

If you notice an error after placing your order, please contact us immediately at:

info@marlowlabel.com

We will attempt to correct the information where reasonably possible, but changes cannot be guaranteed after fulfilment has begun.

10. Product Availability

Products displayed on our website are subject to availability.

An item being displayed online does not guarantee that stock will remain available until an order has been successfully processed.

If a purchased product becomes unavailable before fulfilment, we may:

  • Contact you to offer an alternative
  • Offer an appropriate substitute with your agreement
  • Cancel the affected item and issue a refund

We will not substitute a materially different product without your agreement.

Estimated total: 9–15 business days

These are estimates unless a guaranteed delivery date has expressly been provided.

12. Free Shipping

Marlow Label currently offers free standard shipping to Australia and New Zealand.

Where optional premium, priority, expedited or insured shipping services are offered, additional charges may apply and will be displayed before purchase.

We reserve the right to modify future shipping offers, provided any applicable charges are clearly disclosed before an order is placed.

13. International Shipping & Customs

Because products may be fulfilled internationally, orders may pass through customs or international logistics facilities.

Customs processing can occasionally affect delivery times.

Where duties, taxes or customs charges apply, their treatment will depend on:

  • Applicable local law
  • The destination
  • The nature and value of the shipment
  • The terms shown during checkout

We will not knowingly impose undisclosed shipping charges after an order has been completed.

14. Delivery

Customers are responsible for providing an accurate and complete delivery address.

If a parcel cannot be delivered because the customer supplied an incorrect or incomplete address, additional costs may apply where permitted by law.

Where goods are lost, damaged, significantly delayed or otherwise not properly supplied, your rights will be determined by the circumstances and applicable consumer law.

Our complete delivery procedures are described in our Shipping Policy.

15. Consumer Guarantees

Nothing in these Terms is intended to exclude or restrict any statutory consumer guarantee.

For customers in Australia, products may be subject to guarantees under the Australian Consumer Law.

For customers in New Zealand, products may be subject to guarantees under the Consumer Guarantees Act 1993.

Depending on the circumstances, products supplied to consumers may be required to:

  • Be of acceptable quality
  • Match their description
  • Be fit for applicable purposes
  • Correspond with representations made about them
  • Meet other statutory guarantees

Where a product fails to meet a consumer guarantee, remedies may include repair, replacement, refund or other compensation depending on applicable law and the nature of the problem.

These statutory rights may continue beyond any voluntary Marlow Label returns period.

16. Returns, Refunds & Cancellations

Marlow Label offers a voluntary 30-day change-of-mind return period for eligible products, subject to our Returns Policy.

Different rules apply where products are:

  • Faulty
  • Damaged
  • Incorrect
  • Unsafe
  • Materially different from their description
  • Otherwise non-compliant with applicable consumer guarantees

Statutory consumer rights are separate from our voluntary change-of-mind policy.

Full details are available in our Returns, Refunds & Cancellations Policy.

17. Exchanges

Eligible products may qualify for an exchange subject to:

  • Our Returns Policy
  • Product condition
  • Availability
  • Applicable consumer rights

Exchange arrangements do not remove any statutory rights relating to faulty or non-conforming replacement products.

18. Intellectual Property

Unless otherwise stated, content appearing on the Marlow Label website is owned by, licensed to, or lawfully used by Marlow Label or Seta Services.

This may include:

  • Brand names
  • Logos
  • Website design
  • Written content
  • Product photography
  • Graphics
  • Videos
  • Product descriptions
  • Layouts
  • Artwork

You may use the website for personal, non-commercial shopping purposes.

You may not reproduce, republish, commercially exploit, distribute or use protected website content without permission where such permission is legally required.

Nothing in this section claims ownership over third-party intellectual property.

19. User Content & Submissions

You may choose to provide content including:

  • Product reviews
  • Photographs
  • Videos
  • Comments
  • Feedback
  • Suggestions

You remain responsible for content you submit.

By submitting content specifically for publication or promotional use, you grant Marlow Label a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and adapt that content for legitimate business and marketing purposes, subject to applicable law and our Privacy Policy.

You confirm that you have the right to submit such content and that it does not:

  • Infringe another person's rights
  • Contain unlawful material
  • Contain malicious software
  • Be knowingly false or deceptive
  • Violate applicable law

Where reasonably appropriate, you may contact us to request that voluntarily submitted customer content be removed from future use.

20. Customer Reviews

Customer reviews and testimonials may appear on our website.

Reviews should reflect genuine customer experiences and must not contain misleading, unlawful, abusive or infringing material.

We may moderate reviews for reasons including:

  • Personal information
  • Spam
  • Offensive material
  • Irrelevant content
  • Legal concerns
  • Fraudulent submissions

We do not intend to alter the substantive meaning of legitimate customer feedback solely because it is negative.

21. Third-Party Services

Our website may rely on third-party providers for functionality including:

  • E-commerce hosting
  • Payments
  • Shipping
  • Order tracking
  • Analytics
  • Customer support
  • Marketing
  • Website functionality

Those providers may have their own terms and privacy policies.

Where a third-party service is provided directly by that third party, your use of that particular service may also be subject to its terms.

Nothing in this section removes responsibility that Marlow Label cannot legally exclude.

22. Third-Party Links

Our website may contain links to websites operated by other organisations.

A link does not necessarily mean that Marlow Label endorses or controls the external website.

We are not responsible for external websites that we do not operate, subject to any liability that cannot lawfully be excluded.

You should review the applicable terms and privacy policies before providing personal information or making purchases through another website.

23. Privacy

Personal information collected through Marlow Label is handled in accordance with our Privacy Policy.

Our Privacy Policy explains matters including:

  • Information we collect
  • How information is used
  • Shopify and other service providers
  • Payment processing
  • Fulfilment
  • Overseas data processing
  • Customer rights
  • Data retention

For privacy enquiries, contact:

info@marlowlabel.com

24. Website Accuracy

We make reasonable efforts to keep website information accurate and current.

Occasionally, the website may contain:

  • Typographical errors
  • Pricing errors
  • Incorrect availability information
  • Inaccurate promotional information
  • Technical errors

Where an error is identified, we may correct it.

Where the error affects an order already placed, we will handle the matter fairly and in accordance with applicable law.

25. Website Availability

We aim to keep our website available and functioning properly.

However, temporary interruptions may occur because of:

  • Maintenance
  • Software updates
  • Hosting problems
  • Third-party outages
  • Security incidents
  • Technical failures
  • Events outside our reasonable control

We may temporarily suspend parts of the website where reasonably necessary.

Nothing in this section affects obligations relating to orders that have already been accepted.

26. Prohibited Uses

You must not use our website:

  • For illegal or fraudulent activities
  • To violate intellectual property rights
  • To harass, threaten or abuse others
  • To distribute malware or malicious code
  • To obtain unauthorised access to systems or accounts
  • To collect personal information unlawfully
  • To submit deliberately false or misleading information
  • To interfere with website security
  • To manipulate promotions or checkout systems through fraudulent means

We may restrict access where necessary to protect customers, our business or our systems.

27. Disclaimer

We aim to provide accurate information and reliable website functionality.

However, except for guarantees, warranties or rights that cannot legally be excluded, we do not guarantee that:

  • The website will always be uninterrupted
  • Every feature will always be available
  • The website will always be error-free
  • Every product will remain continuously available

Nothing in this section excludes any mandatory consumer guarantee or statutory right.

28. Limitation of Liability

To the maximum extent permitted by applicable law, Marlow Label and Seta Services will not be liable for indirect, incidental or consequential losses that are not reasonably attributable to a breach by us.

However, nothing in these Terms excludes, restricts or modifies liability or consumer rights where doing so would be unlawful.

In particular, these Terms do not exclude rights or remedies available under mandatory consumer protection legislation.

Any limitation of liability contained in these Terms applies only to the extent permitted by law.

29. Indemnification

To the extent permitted by law, you are responsible for reasonably foreseeable loss caused by your unlawful misuse of the website or material breach of these Terms.

Nothing in this section requires a consumer to indemnify Marlow Label for loss caused by:

  • Our own negligence
  • Our breach of contract
  • Our violation of law
  • Matters for which liability cannot lawfully be shifted to the customer

30. Events Outside Our Reasonable Control

Certain events may affect our ability to perform obligations within normal timeframes.

Examples may include:

  • Natural disasters
  • Severe weather
  • War or civil disruption
  • Government restrictions
  • Major transport disruptions
  • Customs disruption
  • Industrial action
  • Major technical infrastructure failures
  • Events affecting international logistics networks

Where such events occur, we will take reasonable steps to minimise disruption and communicate material delays where appropriate.

This clause does not remove any statutory right to a refund, cancellation or other remedy where applicable law provides one.

31. Changes to Our Services

We may modify:

  • Website functionality
  • Product ranges
  • Future prices
  • Promotions
  • Shipping options
  • Store features

from time to time.

Changes will not retrospectively remove rights already acquired under an existing accepted order or mandatory consumer law.

32. Changes to These Terms

We may update these Terms from time to time to reflect changes in:

  • Our operations
  • Our website
  • Applicable law
  • Shipping arrangements
  • Payment providers
  • Policies
  • Services

Updated Terms will become effective when published for future use of the website and future transactions, unless otherwise required by law.

Material changes will not retrospectively remove contractual or statutory rights relating to an order already accepted.

Last updated: 13 August 2026

33. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

34. No Waiver

If we do not immediately enforce a provision of these Terms, this does not necessarily mean that we have permanently waived the right to enforce it later.

Nothing in this clause allows us to revive a right that has otherwise been waived or lost under applicable law.

35. Entire Agreement

These Terms, together with the policies expressly incorporated into them, form the agreement governing your use of our online store and purchases from Marlow Label.

Relevant policies include our:

  • Privacy Policy
  • Shipping Policy
  • Returns, Refunds & Cancellations Policy

Nothing in this clause excludes representations or obligations that cannot legally be excluded.

36. Governing Law & Consumer Jurisdiction

Marlow Label is operated by Seta Services, registered with the Dutch Chamber of Commerce.

To the extent permitted by law, these Terms are governed by the laws applicable to Seta Services in the Netherlands.

However, this choice of law does not exclude mandatory consumer protections that apply to customers in the country where Marlow Label directly sells its products.

In particular:

Australian customers may retain mandatory rights and remedies available under the Australian Consumer Law.

New Zealand customers may retain mandatory rights and remedies available under New Zealand consumer legislation, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986 where applicable.

Nothing in these Terms requires a consumer to give up access to a court, tribunal or consumer remedy that applicable law gives them.
